My spouse would like to adopt a child of mine from a previous relationship.  Can we do this?

A stepparent adoption is authorized by the Texas Family Code. The Haw Law Firm can walk with you through this emotional and exciting process.

What happens to the biological parent’s parental rights during an adoption?

In order for an adoption, the parental rights of one or both biological parents are terminated.  For a stepparent adoption, one parent’s rights are terminated and the spouse of the other parent adopts the child.  For a non-stepparent adoption, both parent’s rights are terminated for the adoption.

Does The Haw Law Firm help find children for an adoption?

No.  The Haw Law Firm consists of adoption attorneys in Katy, Texas.  We are not an adoption agency, and we are unable to help locate a child for adoption.

The biological parents have agreed to the adoption.  What do I do now?

The biological parents are able to voluntarily relinquish their parental rights. This will open the door for an adoption.  It's important in these cases that the voluntary relinquishment of parental right is done correctly to minimize the chance of having the adoption challenged later.

What grounds are there for involuntary termination?

The Texas Family Code lays out specific grounds when termination is possible.  In any instance, the court will consider the best interest of the child.  The Haw Law Firm can help you decide whether a termination-adoption suit is the best course of action by analyzing your individual situation.  A full analysis generally cannot be completed during the free initial consultation due to the fact-sensitive nature of these determinations, but a longer consultation can be scheduled for a fee.
