Estate Planning

Estate Plan FAQ, Documents, Prices

An estate plan is one of the most loving things you can do for your family.

An estate is all the property you own (cars, houses, personal property).

Everyone has an estate and estate planning is not only for the wealthy.

The first goal of an estate plan is to address your medical decisions and finances while you are living but cannot do it yourself, e.g. are incapacitated.

The second goal of an estate plan is to address what happens to your assets when you die.

WHAT DOCUMENTS ARE INCLUDED?

  • Revocable Living Trust (for trust-based plan only)
  • Last Will and Testament
  • Durable Power of Attorney
  • HIPAA Release
  • Designation of Health Care Surrogate
  • Living Will
  • Agent for Disposition of Remains
  • Declaration of Preneed Guardian
  • Signing Instructions

Why should I use a lawyer?

  • It is very easy to make mistakes on estate planning documents.
  • If improperly signed or drafted, it might not even be a will.
  • It can be very expensive to probate an unclear will
  • Improperly drafted wills can lead to family fighting.
  • Inability to customize: most online will programs offer fill-in-the-blank forms, often not even state specific. Emma drafts each will and trust from scratch, customizing it to the client.
  • You will not know if your will or trust is defective while you are alive. This is often a surprise to your loved ones when they try to probate the will or administer the trust after you die.

What is the Process?

  • Free Phone Consultation
  • Questioinnaire with specific instructions (optional: completed with attorney help)
  • Documents Drafted by Attorney
  • Meeting to review documents (video, phone, or in-person)
  • Documents edited by attoorney per your requests
  • Sign Documents (optional: completed with attorney)

How Much Will This Cost?

You will not be charged before there is an agreed-upon flat fee.

An estate plan includes the stated documents for a flat fee.

Sample prices are published online.  An exact flat fee will typically be quoted during your free initial telephone consultation after Emma gathers facts about your situation. Sometimes, if your situation is complex, Emma will need more information than the 30-minute phone call to determine a fee, and she will tell you what she needs during this call.

A full listing of sample fees are provided at this link.
